These Terms of Service govern your access to and use of the services provided by AppointIQ ("Company," "we," "us," or "our"), including our website at appointiq.io and any related services (collectively, the "Services"). By accessing or using our Services, you agree to be bound by these Terms.
AppointIQ provides performance-based appointment generation services for businesses in agreed-upon verticals including HVAC contractors and legal professionals. Our Services include paid advertising campaign management, AI-powered lead qualification, automated appointment booking, and related reporting and analytics.
As a client of AppointIQ, you agree to:

Advertising spend is paid directly by the client to the respective advertising platform and is separate from AppointIQ fees. AppointIQ does not mark up or profit from your advertising spend. Payment terms are net 7 days from invoice unless otherwise agreed in writing. Late payments may result in suspension of Services.
AppointIQ guarantees a minimum of ten (10) booked appointments within the first thirty (30) days of campaign launch. If this threshold is not met, performance fees will be paused until the shortfall is fulfilled. The guarantee applies only when the client has maintained the agreed minimum advertising spend and fulfilled their obligations under Section 2. The guarantee does not apply to delays caused by client-side issues including unavailable calendar access, slow intake response, or force majeure events.
Service agreements have an initial term of ninety (90) days, after which they continue on a month-to-month basis. Either party may terminate the agreement with thirty (30) days written notice after the initial term. AppointIQ reserves the right to terminate immediately for non-payment, breach of these Terms, or conduct that violates applicable law. Upon termination, all outstanding fees become immediately due.
All landing pages, creative assets, ad copy, qualification scripts, and AI agent configurations created by AppointIQ remain the intellectual property of AppointIQ. Clients receive a non-exclusive license to use these materials during the active service period. Upon termination, this license expires. Clients retain ownership of their own business data, customer lists, and ad account history.
Both parties agree to maintain the confidentiality of proprietary information shared in connection with the Services, including but not limited to pricing, business strategies, customer data, and technical systems. This obligation survives termination of the service agreement.
AppointIQ's liability to any client shall not exceed the total fees paid to AppointIQ in the three (3) months preceding the claim. AppointIQ is not liable for indirect, incidental, consequential, or punitive damages. AppointIQ does not guarantee specific revenue outcomes, close rates, or job values resulting from appointments delivered.
The Services are provided "as is." AppointIQ makes no warranty that the Services will be uninterrupted or error-free. We do not warrant specific appointment volume beyond the guarantee described in Section 4, and actual results will vary based on market, geography, seasonality, and client responsiveness.
These Terms are governed by the laws of the State of Arizona, without regard to its conflict of law provisions. Any disputes shall be resolved through binding arbitration in Maricopa County, Arizona, except where prohibited by law.
AppointIQ reserves the right to update these Terms at any time. We will notify active clients of material changes via email with at least fourteen (14) days notice. Continued use of the Services after changes take effect constitutes acceptance of the updated Terms.

You may disable cookies in your browser settings; however, some features of the site may not function properly as a result. Our Services include AI voice agents and SMS qualification systems that interact with prospects on behalf of our clients. These interactions may be recorded and transcribed for quality assurance and service delivery purposes. Where required by applicable law, prospects are notified that they are interacting with an automated system. Recordings are retained for ninety (90) days unless a longer period is required for dispute resolution or legal compliance.
We retain client account information for the duration of the service relationship and for seven (7) years thereafter for legal and accounting purposes. Prospect contact and appointment data is retained for ninety (90) days from the date of the interaction, after which it is deleted from our active systems. Anonymized aggregate performance data may be retained indefinitely for analytics purposes.
We implement industry-standard technical and organizational security measures to protect personal information against unauthorized access, loss, or disclosure. These include encrypted data transmission (TLS), access controls, and regular security reviews of our third-party service providers. No method of transmission over the internet is completely secure, and we cannot guarantee absolute security.
